Disclaimer & Liability Waiver

Accurate Fabrication LLC ("Accurate Fab," "we," "us," or "our") designs, builds, installs and services custom automotive fabrication, including roll cages, chassis components, exhaust systems, suspension hardware and motorsport-related assemblies. Motorsport, off-road driving, drifting, racing, and the modification or operation of any motor vehicle are inherently dangerous activities that can result in serious bodily injury, permanent disability, death, and property damage.

By purchasing parts from us, hiring us to perform work on a vehicle, allowing us to consult on a build, or operating any vehicle that has been worked on by Accurate Fab, you acknowledge that you have read, understood, and agreed to this Disclaimer & Liability Waiver in full.

Assumption of Risk

You expressly acknowledge that operating a motor vehicle — on a road, on a race track, on a closed course, off-road, at a private event, on a dyno, or in any other setting — involves risks that no part, build, repair, inspection, or installation can eliminate. These risks include, without limitation: vehicle rollover, fire, collision, mechanical failure, component fatigue, weld failure, fastener failure, restraint failure, helmet contact with cage tubing, impact with surrounding structures, and injuries arising from the conduct of other drivers, spectators, officials, or third parties.

You voluntarily assume all such risks, known and unknown, whether or not caused in whole or in part by the action, inaction, or negligence of Accurate Fab.

No Warranty of Safety

Roll cages, harness bars, restraint mounts, fuel system components, exhaust routing, bash bars, skid plates, and any other safety-adjacent parts we manufacture or install are designed to reduce the risk of injury in certain types of incidents. They do not guarantee the prevention of injury or death. No piece of fabricated equipment can compensate for excessive speed, impaired judgment, mechanical failure of components we did not supply, track conditions, the actions of other drivers, or violations of sanctioning-body rules.

Accurate Fab makes no warranty, express or implied, that any product or build will prevent injury, death, vehicle damage, or property loss.

Intended Use; Off-Road and Competition Use Only

Many of the products and modifications we build are intended for off-road, competition, or closed-course use only and may not be legal for sale, installation, or operation on public roads in your jurisdiction. This includes, without limitation: catalyst delete or modified exhaust components, emissions-related modifications, roll cages in street-driven vehicles, modified suspension geometry, and any forced-induction or fuel-system changes.

It is your sole responsibility to determine and comply with all applicable federal, state, local, and sanctioning-body laws, regulations, and rules, including but not limited to those of the EPA, CARB, the DOT, the FIA, SCCA, NASA, NHRA, SFI Foundation, Formula DRIFT, and any other organization governing your use of the vehicle. Accurate Fab does not represent or warrant that any product or build is street-legal, emissions-compliant, or eligible for competition in any particular series or class.

Inspection, Maintenance & Re-Certification

Fabricated components, welds, fasteners, and mounting points must be regularly inspected, maintained, and re-certified per the requirements of the applicable sanctioning body and per generally accepted motorsport practice. You agree that you are solely responsible for:

  • Pre- and post-event inspection of all safety equipment.
  • Replacement of harnesses, nets, mounts and restraints per manufacturer and sanctioning-body schedules.
  • Re-torquing of fasteners after initial use and after any incident.
  • Visual inspection of welds, tubing and mounts after any contact, off-track excursion or significant load event.
  • Following any cool-down, bedding-in, or break-in procedure we communicate at delivery.

Any component that has been subjected to a crash, fire, significant impact, or visible deformation must be removed from service and inspected by a qualified fabricator before further use. Continued use of damaged equipment voids any workmanship coverage and shifts all risk to the owner/operator.

Modifications, Repairs by Others & Third-Party Parts

Any modification, alteration, repair, repaint, re-weld, re-drill, or other change to our work performed by anyone other than Accurate Fab voids any workmanship coverage and releases us from all liability associated with the affected component or system.

Where our work integrates with third-party parts (including but not limited to seats, harnesses, fuel cells, engines, transmissions, brake components, ECUs, and tires), Accurate Fab makes no representation about the design, manufacture, or suitability of those third-party parts and is not responsible for their failure.

Estimates, Quotes & Project Pricing

Pricing calculators, configurators, and ballpark figures displayed on this website (including the Roll Cage estimate tool) are preliminary estimates only and do not constitute a binding quote, proposal, or contract. Final pricing depends on vehicle condition, scope, material cost at time of build, shop schedule, and additional work uncovered during disassembly. A binding quote is provided only in writing once the vehicle has been evaluated.

Release & Limitation of Liability

To the fullest extent permitted by law, you, on behalf of yourself and your heirs, executors, administrators, assigns, insurers, and personal representatives, release, waive, and forever discharge Accurate Fabrication LLC, its owners, employees, contractors, agents, and affiliates from any and all claims, demands, actions, causes of action, damages, costs, expenses, and liabilities arising out of or related to the design, manufacture, sale, installation, modification, inspection, repair, or use of any product, vehicle, or service supplied by Accurate Fab, whether caused by the negligence of Accurate Fab or otherwise.

In no event will Accurate Fab's aggregate liability arising out of or relating to any product or service exceed the amount actually paid by you to Accurate Fab for the specific product or service that gave rise to the claim. Accurate Fab will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, loss of use, loss of vehicle, or down- time, even if advised of the possibility of such damages.

Indemnification

You agree to defend, indemnify, and hold harmless Accurate Fabrication LLC and its owners, employees, contractors, agents, and affiliates from and against any and all claims, damages, judgments, awards, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) brought by any third party arising out of or relating to your operation of any vehicle worked on by Accurate Fab, your installation or use of any product supplied by Accurate Fab, or your violation of this Disclaimer.

Severability & Governing Law

If any provision of this Disclaimer is held to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect. This Disclaimer is governed by the laws of the State of Connecticut, without regard to its conflict of law principles. Any dispute will be brought exclusively in the state or federal courts located in Hartford County, Connecticut.
